Not sure how this will pan out; I believe though that in order to be grandfathered, the product needed to be commercially available prior to the 2007 date and thereafter. Not sure how they would interpret temporary periods of product unavailability. A shortage? Maybe? Discontinuing for a period and re-introducing? Perhaps not.
Just speculation.
