New Type Of Smoking Ban To Be Proposed For NYC

Councilman’s bill would ban smoking while walking on city sidewalks

A city pol wants to snuff out smoking while walking.

A bill being introduced in the City Council Wednesday by Councilman Peter Koo would ban puffing a cigarette while walking along a city sidewalk.

Smokers standing in one spot on the sidewalk would still be allowed to light up.

Koo (D-Queens) said he wants to spare fellow pedestrians the nuisance of being caught behind a smoker and breathing in secondhand smoke.

“It has happened to me many times — I'm walking behind someone who's smoking, and I'm suffering for five or 10 minutes,” Koo said. “I see mothers with their strollers walking behind people who smoke, and they're exposing the baby to secondhand smoke.”

It's already illegal to smoke in city parks, as well as inside bars, restaurants, stores and other indoor public places.

If the new legislation passed, pedestrians caught blowing smoke could be hit with a $50 fine, the same penalty that currently applies in parks.

The smoking while walking ban would also apply to street medians and Parks Department parking lots.

The Queens pol said he's moving to legislate what should be common courtesy.

“In a perfect world, every smoker would have the self awareness to realize smoking while walking subjects everyone behind you to the fumes,” he said.

Some smokers cried foul, noting that existing restrictions leave the sidewalk as one of the few places they're allowed to puff.

“I think that’s unreasonable,” said Ceia Cremo, 48, of Jackson Heights. She was smoking an American Spirit as she walked down Fifth Ave.

“Where else do I have left to smoke? You can't smoke in the park, you can't smoke in a lot of places.”

But some pedestrians welcomed the proposed ban.

“I think they should ban it. I feel like some people don't pay attention because when they're smoking they don't realize there are people behind them. If you're behind, it's directly in your face,” said Latoya Smith, 39, of Clinton Hill.

A Staten Island smoker who gave his name as Rosario, who was puffing a mini cigar as he walked in Midtown, agreed with the bill.

“We're victims of this stupid habit,” he said, adding of the potential $50 fine, “It should be $100. And that opinion comes from a smoker.”

Ugh. I hate breathing someone's second hand smoke as much as anyone and I never would walk down a busy sidewalk smoking a smelly cigar but to actually pass a law banning something that is little more than an inconvenience or even just a stench?? Next they should ban body odor and passing gas. I've been in line behind some unwashed slob reeking of BO and let me tell you, if he would have been smoking a cigar to mask the funk that would have been a relief I'd have welcomed.

Well, I'm not really lookin' for this stuff tonight but here's news on another front of legislation.

No Premium Cigar Exemption In $1.3 Trillion Budget
    MARCH 21, 2018 | By Andrew Nagy
No Premium Cigar Exemption In $1.3 Trillion Budget
Congressional leaders have reached a consensus on a $1.3 trillion spending package, and Cigar Aficionado has learned that a bill to exempt premium cigars from FDA regulation was not included in the final version.

Variations of the cigar-exemption bill have been introduced in both the U.S. House and Senate in past years, but they have never passed. During this most recent round of budget talks, the bill was folded in as a rider and included language that would have blocked the FDA from using any of its funding to regulate “traditional large and premium cigars.”

Facing a Friday deadline to avoid yet another government shutdown, talks between Republicans and Democrats heated up in the past few days as the two parties attempted to come to an agreement on what riders should be included in the final spending package. According to sources, the cigar-exemption language was one of the final riders to be cut.

“We are extremely disappointed that the bill to exempt premium cigars from FDA regulation was not included in the final omnibus budget package released today,” said Drew Newman, general counsel of J.C. Newman Cigar Co. “When Congress adopted the Tobacco Control Act in 2009, it never intended for premium, handcrafted cigar companies like ours to be regulated out of business—but that is exactly what the costly and overbearing requirements of FDA regulation threaten to do.”

While the bill has not officially been released, the White House has announced its support.

“Although we are disheartened today, we remain optimistic that the premium cigar industry will ultimately obtain relief—through legislation, litigation, or regulation—from the crippling components of FDA regulation,” said

I seen Rocky Patel on Fox News the other night talking about the regulations on cigars. Maybe we should ban perfume and scented deorderant....

That's right! I'm highly offended by the Lakeland Essence that some old ladies seem to bathe in.
