The tobacco ebay policy exist for selling tobacco as a way they can get the fee and get around people not having tobacco licensees. In your example it wouldn't even apply because your not selling tobacco. Try to understand that although your selling the packing if you advertise it as intact or new it has to be so or it is fraud.
I whole heartedly disagree, the way that 90% of them are listed you will have no recourse. What if the cigars are all dried out and unsmokable? Again zero recourse because you didn't buy cigars you bought the packaging.... By all means, buy all the cigars on ebay you want, I will be waiting for your thread "How I got F*@&ED on Ebay". I have bought and sold many things on ebay, have been through plenty of disputes, won some and lost some.
