Sadly, the government just expects the retailer to absorb the loss (or pass it on to your customers). If you know 10% of your shipment will be destroyed, you need to make it up with the sales of the ones that survived.
It's really just a hidden tax. They want to keep making it more and more expensive to smoke, hoping that people decide to just stop. However, this has been proven time and time again that it does not work. People just start turning to illegitimate ways to get what they want. This leads to questionable quality and increased health risks, just look at the "cuban" cigar market in the US.
If this continues for too long, it's going to do serious damage to the already fragile B&M network. Once again, reducing market options.

So here's an update. I responded to customer service with a full list of the cigars they failed to include. A few days later they got back to me and asked if I wanted a refund for those or if I wanted them to ship them. I responded that I would like them shipped, thanks.
A few days after that they responded that they didn't actually have any of them in stock. They said they could substitute some other cigars instead and gave me a list of substitutions.
Wanting to get the entire ordeal over with a month after my original order, I agreed to it.
Let's hope that's an end to this horrible ordeal.
It's not a real hobby unless it interferes with your work.

I have to admit I don't know you or your sites nor do I particularly care. I'm winding down my purchases, especially after this fiasco (and the FDAs unresolved new rules which prompted me to double my stock).
I have all I need to smoke for the next five years at least. Best of luck to you though.

What a headache that sounds like! Sounds like they are short-handed and short-stocked.

I won the bidding for a Peterson Fermoy 264 Canadian pipe from them and received it in the mail Monday. After examining it, I determined that it had been smoked. It had tooth marks on the stem, had a light carbon buildup in the bowl and smelled like tobacco. They are sending me a return shipping label via email.
Follow-up (10/06/2016): They replaced the pipe and all is good! It was a little bit of a hassle but it all worked out in the end.
